A legal department?s business functions?

In-house lawyers are rarely involved in decision-making at the corporate level and their involvement in key strategic decisions remains limited. This can probably, at least partially,? be explained by the professional and cultural differences between business managers and lawyers. The fundamental question in this respect is what the legal department can contribute to the business?

The answers to this questions can be used to structure a legal audit and set specific objectives, by top management and or the general counsel, to manage the company?s regulatory function. The potential contributions are in this blog evaluated for five business areas: strategic input, testing and contributing to strategies, reputation management, risk management and change management.?

Strategic Input

For strategic input the analytical and legal research skills in which lawyers are well trained can be used to identify regulatory developments and risks. However, managers should ensure, by giving lawyers a proper briefing, that the analysis is not just focused on legal matters, but translates the legal findings into practical business input.

The legal function can support the business in its strategy development process by a continuous process of analysing the relevant national and international regulatory environments. This involves monitoring of the relevant developments in the sources of law and self-regulation. Those who are interested in a model to do so should not hesitate to contact me.

The legal function can perform an internal analysis on the extent to which other functions identify and use regulatory opportunities, or are confronted with regulatory threats that interfere with achieving the function?s objectives. The results of analyses can be submitted to the company?s management as input into the strategy development process. They will evaluate the information to decide which points should be included in a SWOT analysis, which is used for corporate planning purposes.

Testing and Contributing?

Strategic options must be evaluated form a regulatory perspective to assess their feasibility and risks. However, lawyers in this planning phase should not focus primarily on the potential regulatory risks and problems, but also on the opportunities the regulatory environment offers for example to improve competitiveness and specifically the firm?s marketing mix. For testing and contributing, creativity and innovative thinking are needed. Lawyers will have no problems in developing legal options for legal problems. Whether they can contribute effectively to the process of developing creative business options is less obvious, since they are not by nature and education ?out-of-the-box? thinkers.

Reputation Management?

It is the legal department that protects the company from negative publicity by realising compliance, proper corporate governance, proper contracts and effective dispute resolution processes. The legal function can make contributions to the 6 C?s of reputation ( see my previous blog on this topic)

The drafting skills of lawyers can for example be used to write and update codes.? It is also the legal department that can point out the specific regulatory risks involved in doing business with counties with a poor reputation. An effective? role in protecting reputation requires the management of the company and the general counsel to set specific objectives related to reputation management for the regulatory function.

?Risk Management?

The mind set of lawyers is focused on identifying future legal problems in order to take legal measures to avoid legal risks. Lawyers tend to be risk-averse where managers operate in a setting where some risks cannot be avoided and are therefore considered acceptable. The two different mind sets need to be reconciled to make the cooperation with respect to risk management effective. It requires lawyers to consider legal opportunities such as reservation of ownership and contract clauses from a risk management perspective.

Change Management?

In case top management or the general counsel wants to change the role of ?legal? it will initially encounter, as always with change, resistance. It would, however, be beyond the scope of this text to devote detailed attention to the business theories on ?change management?.?

Change can be initiated by setting specific performance targets. Managing a legal department by performance management requires objectives to be set for all department?s employees. By introducing performance measurement, the legal function can align itself better with the wider business strategies.

Involving the legal function in strategy also requires other typical management tools such as job descriptions and policies for motivation, staff development, performance appraisal, remuneration structures and communication and reporting systems. Job descriptions, for example, can facilitate the alignment of legal with the company objectives and strategies by including the responsibility of analysing the legal environment and providing strategic input.? In general, agreed-upon structures and defined responsibilities are required for commitment and accountability.?

A more effective cooperation of legal and business functions can also be realised by forming teams in which business managers and lawyers work together. The Dutch multinational Akzo Nobel is an example of a company where drafting and finalising contracts are managed by multidisciplinary teams of which, as a principle, one or more in-house counsels are members. Every business unit has a legal account manager, who is responsible for ensuring that the business strategies and legal activities are aligned.

Conclusion

To increase the effective involvement of lawyers in business planning, the company and functional culture need to be aligned to their new role. Lawyers should be stimulated and trained to learn about the company and its strategies and to develop an extensive internal and external network enabling, them to increase the business focus in their work. The challenge for lawyers is to overcome their ?natural conservatism and self-reliance?, which does not contribute to being an effective management advisor.

Back-to-school gives retailers a good August

Most retailers, including Costco Wholesale Corp and Limited Brands Inc , posted better-than-expected sales gains at existing stores in August, in what is expected to be a healthy month as parents and students wrapped up back-to-school purchases.

Analysts expected 19 retail chains to report a 2 percent rise in August sales at stores open at least a year, or same-store sales, according to Thomson Reuters I/B/E/S. Excluding drugstores, which do not put out their numbers until next week, same-store sales are expected to rise 4.1 percent.

Same-store sales are an important measure of retailer performance because they strip out the effects from store openings and closures.

Limited, which owns the Victoria's Secret, Pink and Bath & Body Works chains, saw same-store sales rise 8 percent, well above analysts' average view of 4.2 percent.

Stage Stores Inc's same-store sales rose 6.5 percent. Led by back-to-school merchandise, women's clothing and strong selling of items at full price, the department store operator posted its highest August same-store sales increase since 2004, Chief Executive Michael Glazer said in a statement.

Costco posted a 6 percent gain in comparable sales as higher fuel prices offset a stronger dollar.

Teen retailer The Buckle Inc also did well, with a comparable sales rise of 4.5 percent. However, rival The Wet Seal Inc said comparable sales were down 18.3 percent, a steeper decline than analysts anticipated.

"August same store sales estimates have crept upward throughout the month coupled with generally positive reports from retailers on initial back-to-school sales," Ken Perkins, analyst at Retail Metrics, said before results began to trickle in.

Retail Metrics expected sales to rise 1.8 percent. Leaving aside drugstores, it said sales were expected to rise 4.2 percent.

Manhattan floods during Hurricane Irene

Flood insurance is no longer a concern solely for New Yorkers shopping for second homes in Florida; it?s for residents of Manhattan apartments, too. According to the Wall Street Journal, as the Federal Emergency Management Agency has updated its flood-zone maps to designate some New York City locales high-risk zones, banks have begun demanding that purchasers of pricey Manhattan condos buy flood insurance.

New Yorkers in Queens, Staten Island and, of course, the Hamptons were the first to be affected, but Manhattanites and residents in nearby Jersey City are joining the pack. The Journal pointed to a prospective buyer of a fifth-floor unit in a Tribeca condominium who couldn?t secure a mortgage from Bank of America even though the building was already insured for natural hazards by Lloyd?s of London. BofA required a policy underwritten by FEMA?s National Flood Insurance Program. Real estate agent Terrence LeRay said he?encountered a similar situation at his 10th-floor condo unit in Dumbo.

?What we see is a map from FEMA,? a BofA spokesperson told the Journal. ?If a property shows up to be in a flood plain, and there?s no reason to believe the FEMA map is wrong, we require flood insurance.?

Antelope Valley Coach Charged With Molestation

A longtime Antelope Valley youth soccer coach has been charged with sexually molesting 13 young boys, including five whom he coached, according to the Los Angeles County District Attorney's Office.

Renior Vincent Valenti, 50, of Lancaster, pleaded not guilty Thursday to five felony counts of continuous sexual abuse and eight misdemeanor counts of child molesting.

His arraignment in Antelope Valley Superior Court came more than two weeks after the Los Angeles County Sheriff's Department announced investigators were looking for additional victims to come forward.

Detectives from the sheriff's Special Victim's Bureau interviewed more alleged victims and prosecutors added the additional charges.

A Thursday's hearing, Judge Chris Estes raised Valenti's bail from $1 million to $2.25 million.

An American Youth Soccer Organization (AYSO) coach for 15 years, Valenti was arrested in July after a mother alleged that her 9-year-son had been molested by him, according to an Aug. 15 press release from the Sheriff's Department.

The molestation allegations that led to an investigation into Valenti were not related to him being a coach, but investigators "believe that the suspect used his position as a soccer coach as a method to meet and befriend children," the Aug. 15 press release said.

Valenti was first charged Aug. 8 with crimes related to five boys. Those crimes occurred between 1994 and 2004 for one victim, and in 2010, 2011 and 2012 for the other victims.

The investigation is continuing, the DA's office said.

Renior's name was originally released as "Renoir" in the earlier press release from the Sheriff's Department.

Female Syrian Olympic hurdler DQ'd for doping

LONDON (AP) ? A female hurdler from Syria was kicked out of the London Olympics on Saturday after failing a drug test.

The IOC said 400-meter hurdler Ghfran Almouhamad tested positive for the banned stimulant methylhexaneamine on Aug. 3. Her backup "B'' sample confirmed the positive finding.

The 23-year-old athlete finished eighth and last in her first-round heat on Aug. 5.

The IOC said Almouhamad has been disqualified and stripped of her Olympic accreditation.

The IOC sent her case to the IAAF to officially change the results and consider any further action against the athlete.

Almouhamad was one of 10 Syrian athletes, six men and four women, registered to compete in seven different sports in London. The Syrians came to the Olympics despite the escalating violence in their homeland.

Protests against President Bashar Assad's regime began in March 2011 and became a civil war which activists say has killed at least 20,000 people.

The head of the Syrian Olympic Committee, Gen. Mowaffak Joumaa, was denied a visa to come to London by British authorities.

Almouhamad is the seventh positive case reported by the IOC since the Olympic body started its games testing program on July 16. She is only the second athlete who competed in London that has been sanctioned for doping. The others were caught before competing.

American judo fighter Nick Delpopolo was expelled after testing positive during competition for marijuana, which he said he unintentionally consumed in something he ate.

Gymnast Luiza Galiulina of Uzbekistan and Albanian weightlifter Hysen Pulaku were expelled for failing pre-games tests. Galiulina tested positive for the diuretic furosemide, while Pulaku was caught for using the steroid stanozolol.

Russian track cyclist Victoria Baranova was disqualified after testing positive for testosterone on July 24 in Belarus, and Colombian 400-meter runner Diego Palomeque was suspended for a testosterone positive on July 26 in London.

Italian race walker Alex Schwazer was formally disqualified by the IOC after the Italian Olympic Committee removed him from the team for a positive EPO test in Italy before the games.

China trade decelerates in sign of global weakness

BEIJING (AP) ? China's trade growth plunged even more sharply than forecast in July in a new sign of global economic weakness.

Exports rose just 1 percent over a year earlier, down from June's 11.3 percent rate and below forecasts of about 5 percent, data showed Friday. Import growth fell to 4.7 percent from the previous month's 6.3 percent and also below forecasts.

The figures follow disappointing data Thursday showing weak Chinese factory production and retail sales in July. They add to signs the world's second-largest economy is still struggling with its deepest downturn since the 2008 global crisis despite repeated government stimulus efforts.

The latest signs of weakness have prompted calls for still more stimulus measures. Beijing has cut interest rates twice since the start of June and is pumping money into the economy through higher spending on building low-cost housing and other public works.

Economic growth fell to a three-year low of 7.6 percent in the quarter ending in June. The International Monetary Fund and private sector analysts have trimmed their forecasts for the year but say growth should be about 8 percent ? above the official 7.5 percent target but below the double-digit rates of recent years.

The slowdown is politically dangerous for the Communist Party because it raises the risk of job losses and unrest at a time when the ruling party is trying to enforce calm ahead of a handover of power this year to younger leaders. Export industries employ millions of workers and weak sales, coupled with higher costs, have led to a wave of bankruptcies.

China's trade growth has fallen steadily this year as global demand for its exports cooled and efforts to boost domestic consumption have failed to gain traction as fast as the government hoped.

In July, its global trade surplus narrowed by 20.3 percent from July 2011 to $25.1 billion but was this year's second biggest after June's $31.7 billion.

Exports were $176.9 billion while imports were $151.8 billion.

The trade surplus with the 27-nation European Union, China's biggest trading partner, narrowed by 37.9 percent to $10.8 billion, reflecting sluggish European demand due to the continent's debt crisis. The surplus with the United States narrowed by 4.8 percent to $19.9 billion.

Beijing has set a goal of increasing total trade by 10 percent this year, a target that looks increasingly hard to meet. Trade grew 9.2 percent for the first half of the year but the rate fell to 7.1 percent for the first seven months.

Better Gaming Bureau ? The Fastest Growing Video Game ...

Let me quell the fears of many veterans by saying this right away: Ghost Recon did not turn into Call of Duty with Future Soldier.? Well, not completely. It IS readily apparent that the Ubisoft developers were influenced by the world?s best selling franchise when it comes to the game?s campaign events.

After a dirty bomb kills a team an American Ghost Team named ?Predator?, you become part of Ghost Team ?Hunter? as they travel from Bolivia to Russia and everywhere in between, unraveling a Russian conspiracy every step of the way. As expected of any military shooter made in the last 5 year, there are large amounts of uncontainable explosions and acts of military machismo being delved out, and Russians serve as the main enemy and point of conflict in the game. But instead of focusing on the now ubiquitous threat of total nuclear warfare in games, Future Soldier deals with much more covert, behind the scenes battles, and does so with some well polished gameplay.

Where Ghost Recon: Future Soldier really separates itself from the popular first person shooters is in its teamwork, technology, and stealth oriented gameplay. The really stellar missions in the game will have you infiltrate a highly secured area using all of your abilities to remain unseen and unheard until the deed is done. To help with this, the game provides you with an arsenal of instruments ranging anywhere from the extremely handy MAV drone that can spot and mark enemies from above to an incredible ?Dog? mech that walks on all fours while blasting the hell out of anything in sight. There?s also an awesome ?Team Shot? mechanic where you can spot up to four enemies and eliminate them on your cue in sync with the rest of your team. The game does nothing mind blowing in the world of third person shooter gameplay, but creeping your way through the game just feels right, and provides an incredibly satisfying challenge, especially on those missions where its ?Game Over? if someone sees as much as the big toe attached to your body.

For those who don?t enjoy exercising their inner Solid Snake, running and gunning is somewhat possible in this game, but doing so will likely leave you looking like Swiss cheese and wondering where it all went wrong. Even in the game?s enjoyable competitive and cooperative multiplayer, a team?s success depends much more on seeing and not being seen than it does on twitch reflex shooting like most of today?s games. Whether trying to complete objectives before an enemy team, or taking on waves of enemies in the game?s version of ?Horde? mode, Future Soldier never abandons the foundation Ghost Recon has laid over the years, and that?s a good thing.

The only somewhat major misstep Ghost Recon: Future Soldier makes is in its absolutely frustrating design choices at certain points in the game. For the most part, the game?s style really sends the futuristic message home.Holographic words that remind me of your location and mission fill the sky at all times, and the HUD is nicely woven into your character and the action on screen rather than being a stagnant overlay. During specific missions, such as one where you infiltrate an airport at night, the backdrop and environment look absolutely gorgeous and fresh, with lighting, colors, and graphical bells and whistles that really pop and add to the futuristic feel of the game. They are almost Cinema-like, and really enjoyable to look at as you snap necks in the dark.

But at many other junctions, the game throws you in the same old woody forest or broken down urban jungle that appears in every modern shooter. Unlike the well designed set-pieces some of the other levels show, these more pedestrian areas of operation look dull, jaggy, and even grainy at certain points. I have never seen a game go back and forth from Stunning to Humdrum as much as this game does, and its really unfortunate because the graphical fidelity would be there if Ubisoft held to their artistic guns the whole way through.

Also, some of the mission design itself is questionable. I could?ve done without some of the On Rails segments, especially when a game champions its stealth prowess. Another particularly major mission later in the game devolves into an annoying footrace through an enemy-infested, which makes absolutely no sense story or gameplay wish. This mission seems to only be designed that way to move the game along at a pace that felt completely unnatural in comparison to the rest of the narrative, and really hampered the overall experience quite a bit for me.

Some poor design choices aside, Ghost Recon: Future Soldier advances the series several years forward in time both plot wise and gameplay wise. All the little techno-goodies the game puts at your disposal are a blast to work with and help shake up a genre that is quickly going stale. if you are a Ghost Recon fan, this game is a must have. For anyone looking to get into the franchise or just wants a game that is chocked full of new concepts, lots of style, and rock-solid gameplay, give Ghost Recon: Future Soldier at least a little of your time, as well.

If you want sound where you want sound, that's a huge plus.

The Qmadix iharmonix Q-i-sound Stereo Bluetooth Speakers come with a decent leather-like carrying case that does look a little like a 1950s hosiery package, which was... disturbing. But it's convenient none-the-less.

The box also contains a charging cable, wall plug adaptor and a user manual that I will never look at either. Just plug the cable into the Qmadix iharmonix Q-i-sound Stereo Bluetooth Speakers and they charge, and their built-in lithium-polymer batteries hold that charge about as long as they claim -- 8 hours of play time, 240 hours of standby. It does take about 3.5 hours to charge them, however, so if you have a long trip or big party coming up, make sure to plan your charging accordingly.

The left speaker has a power button, mic, volume, and skip forward and back buttons, while the right speaker only has a power button to activate it.

Bluetooth setup is as easy as you've come to expect from iOS, and straight forward once you put it into discover mode by holding the power button for 5 seconds. They have the same range as other Bluetooth devices, about 30 feet, and the speakers themselves can be positioned up to 15 feet apart.

Now here we come to sound quality -- the Qmadix iharmonix Q-i-sound Stereo Bluetooth Speakers isn't bad except that there is quite a bit of distortion at high volume levels and there is no bass to speak of. That turns me off to these speakers.

Granted the Qmadix iharmonix Q-i-sound Stereo Bluetooth Speakers are significantly cheaper than the Jawbone JAMBOX, but we're living in a post-JAMBOX world now and we no longer put up with small sound from small Bluetooth speakers. Expectations have been set.

They have a mic, so you can have Qmadix iharmonix Q-i-sound Stereo Bluetooth Speakers serve double-duty as speaker phones for conference calls as well. As expected, they sound better than the tiny iPhone and iPad speakers both for telephone and for FaceTime and Skype.

Today's College Students are the Next Great Generation and Here's ...

They are the first generation of college students to grow up with the Internet and the first to cross the chasm from the pre to the post-Internet Age. Lifestyles of the Non-Upwardly Mobile

The life model for Generation X and Tom Brokaw's "Greatest Generation" was to commit totally to aHooked Up job and job security. For the Greatest Generation, this meant mothers in unpaid work at home and fathers who were rarely home. For Generation X, it meant both parents working long hours outside the home with children in the care of daycare centers, nannies, babysitters, relatives and a string of after-school enrichment activities. More men in this generation have taken an active role in childrearing, and this pattern will accelerate among Internet Pioneers and Natives, who will be more likely to put families ahead of careers, even changing jobs and careers to adjust to changing family requirements.

According to the Bookends Generation study conducted by New York City's Center for Work Life Policy, 89 percent of current college students report valuing flexibility in their work life as among the most important aspects of a happy work environment. For Baby Boomers, flexibility meant leaving work early to catch their children's ball games or dance recitals. For Internet Pioneers, flexibility includes the ability to work from home -- or anywhere -- as an acceptable option. Tim Ferriss' The Four Hour Work Week even suggests putting in a full week's worth of work from a tropical island. As long as the island has wireless connectivity, this scenario is entirely possible for the next wave of Internet-bred corporate managers (assuming they can pay off their student loans and afford to travel).

Their focus on outside-of-work success may lead to a very different work landscape than before, with greater flexibility in how jobs are performed so long as benchmarks are met, and with the need for corporations to demonstrate social responsibility far beyond the degree to which they contribute today. Internet Pioneers will be less tolerant of corporate malfeasance and will be aggressively intolerant of a Profit at Any Cost approach to corporate strategy.

Because the generation overall considers global impact as important as financial gain, today's college students may be able to alter the direction of businesses as a whole -first by altering employment policies and later through their influence within the management chain.

Again, the Internet Pioneer generation of college graduates doesn't feel bound to follow the implied contract of job loyalty that served their parents and grandparents. For earlier generations, a college diploma meant a middle-class job and upward mobility. However, a combination of economic recession and overabundance of college-educated candidates means this is no longer true.

The Next Great Generation

Red Tree Leadership, a management training consultancy, describes today's college students as potentially being the "next great generation." How big businesses choose to deal with this incoming cohort of new team members over the next few years will have a powerful influence on the future of each company. Corporations that underestimate Internet Pioneers and Internet Natives do so at their own peril. Internet Pioneers have the potential to change, streamline and improve business ethics and communications from the ground up.

Internet Pioneers may need guidance from senior colleagues about the politics and social mores within corporations, but senior managers will, in many ways, have far more to learn from their younger colleagues. Internet Pioneers have grown up with the ability to multitask, to access information at any hour, and to conduct work from any place with an Internet connection. Many will be willing to work for less money, and even for more hours, if given the flexibility to work on their own schedules with liberal telecommuting opportunities. Even with the challenging reality of a tough job market for Internet Pioneers, they have the values, work ethic and self-esteem to face these challenges with determination and vision.

They may initially step back and wait for more appropriate timing ? meanwhile accepting roles they perceive as jobs rather than careers. But they will inevitably gain a foothold in small businesses, large corporations, education, government, non-profits, the arts and organizations. Once they gain that foothold, their unique perspectives and skills will enable them to mature quickly in their roles, bring new insights, and move up the career ladder into positions of increased responsibility and authority.

Employers who recognize these individuals and seek their counsel, contributions and ideas will be well rewarded. On the other hand, employers who fail to empower Internet Pioneers will find themselves rapidly becoming irrelevant.

Finding Their Way

Internet Pioneers prefer to avoid conflict, are uncertain of how their opinions will be received and are, therefore, often reluctant to voice them forcefully. They may, however, begin to find that voice as they move through their college years, gain more confidence, emerge into graduate schools and the workforce, and realize how advantaged they are and how uniquely qualified they will be to manage organizations and direct strategies. Internet Pioneers are likely to achieve success following the volatile economic and social climate of the next two decades, more so than the X-Gens who are finding themselves less relevant in a business world that is increasingly digital.

As the nation and world emerge from the period of upheaval caused by the technological inventions of the past two decades, we will move faster and further into the application period of the Internet Transformation. As change accelerates, the need for economic, political, societal and organizational stability will increase.

From our current perspective of economic uncertainty and political dissension, the future may seem hazy. Internet Pioneers are just a few years away from imprinting their values on the nation and world. Their priorities and challenges will be many: to advance logic, honesty and human rights into the corporate mainstream, and to assure that we return to policies that are of, by and for the majority of the American people and the people of the world.

In the coming decades, Internet Pioneers and subsequent generations of Internet Natives will dominate the workforce. Those organizations that empower them will be best positioned for success.

NJ's MetLife Stadium to host huge celebration of Talmud

In what is being hailed as the "largest celebration of Jewish learning in the last 2,000 years," nearly?100,000 people are expected to gather in?New Jersey's MetLife stadium in East Rutherford Wednesday night to mark the completion of a seven and a half year exercise in reading the entire Talmud.

The $4 million event Wednesday night will draw nearly 100,000 people to mark the completion of the reading of the Talmud. The event has been two years in the making.

Rabbi Yosef Golding, who is coordinating logistics, says organizers have 50,000 ponchos and 35,000 towels on hand should it rain.

Golding says security will include 660 New Jersey state troopers, as well as federal agencies.

Organizers call it the "largest celebration of Jewish learning in the last 2,000 years."

Many attending have read one page of the Talmud, which pertains to Jewish law, each day for seven and a half years.

Enghouse Expands Its Portfolio of Contact Center Vendors ?

A look at Enghouse Interactive?s Products page?shows it is not the easiest of companies to understand. Listed are six products ? companies actually ? that make up the parent: Arc Solutions, CosmoCom, Datapulse, Synellect, TelRex and Trio. As yet this list doesn?t include the latest acquisition, Zeacom. All the businesses in some way connect to multichannel communications and the contact center, with products that range, respectively, from communication management systems for Cisco, a cloud-based contact center, unified communications applications that improve collaboration between employees within an organization, a premises-based multichannel contact center, IP call recording and workforce management, and telephony systems, with Zeacom adding a cloud-based unified communications system based on Microsoft Lync.

Since Enghouse Systems Ltd. was formed in 1984 as a software and service company, the company has pursued an aggressive acquisition strategy but has largely left the companies it acquires to operate as independent businesses. This strategy serves Enghouse Interactive?s objective to provide systems that support organizations as they come to grips with customer interactions that arrive through an increasing number of communication channels. My research into cloud-based contact centers?shows that this is no easy task; companies today support around five interaction channels, and the number is rising with the introduction of chat, text-based messages and social media.? The research also shows that many companies see cloud-based systems as the answer, so it is no surprise that Enghouse Interactive makes several of these systems available in the cloud.

The primary example is CosmoCom. CosmoCall Universe is an all-in-one, multimedia, multichannel (telephone, video, email, text, IM and collaboration) contact center suite, which includes ACD, IVR, video-based IVR and interaction recording. It also supports intelligent interaction routing, as all interaction types, regardless of media, are placed in a single queue and routed based on the same rules. Single-queue interaction routing is supported by CosmoDesigner, which is an easy-to-use graphical tool that allows users to build interaction flows by dragging and dropping icons into a flow diagram, which is then converted to routing rules.? The product includes an agent desktop, web-based administration, performance dashboards and a full set of reports.? It is all IP-based, built to be highly scalable, and supports multitenancy architecture. ?These last three capabilities make it ideal for CosmoCom?s primary market, which is telecom service providers and large outsourcing companies that run the software as the basis for on-demand contact center services. For example, British Telecom?s Next Generation Contact Center (NGCC) is a network-hosted contact center that allows BT to offer its customers contact center services that are fully under the control of the customer because the platform is multitenant ? each customer can administer the service as if it were their own.

Enghouse?s Syntellect?CIM product includes capabilities similar to those of CosmoCom but aimed at the on-premises market. It offers unified multichannel interaction management (inbound and outbound voice, email, fax, SMS, social media and chat), intelligent routing, an agent desktop, recording and a comprehensive set of reports, plus post-call surveys and a complete searchable customer interaction history called iVault. Intelligent routing is achieved by converting all interactions to tasks, which are then managed from a single queue based on one set of rules. Rules can include agent profiles, so that interactions can be routed on more than agent skills; for example, they could be routed to the agent with the best success rate at handling a particular type of interaction. They also include predefined escalation rules so that tasks can be raised in priority. The architecture is highly scalable, distributed and designed to be fault-tolerant, with built-in redundancy at multiple levels. Although aimed at on-premises installations, the platform can be offered as a cloud-based, but not fully multitenant, system.

The Zeacom acquisition adds another multichannel contact center?platform to the portfolio. The Zeacom platform includes a workflow engine and capabilities to support business process automation ? two major differentiators that support companies? efforts to redefine their multichannel interaction handling processes. It is based on the Microsoft Lync platform, and so offers unified communications and collaboration capabilities.

In CosmoCom, Syntellect and Zeacom, Enghouse Interactive has made three acquisitions with very similar top-line capabilities but several lower-level variations. The question this raises is where this is all heading. More acquisitions to buy more market share? Not so, I was told. The long-term objective is to rationalize the portfolio to create a full-featured cloud-based interaction management platform that maximizes the relationships with Cisco and Microsoft. The company therefore continues to invest in product development across all three platforms, along with more technology-based partnerships and an ecosystem of partners to provide sales and services around the globe.

Enghouse Interactive is company to watch, with some interesting products that, if successful, will match up to the way our research suggests the interaction management market is moving.

FUELING THE SPECULATION: Romney is back in the U.S. after an international trip plagued with gaffes, and at an event tomorrow in Colorado, he will share the stage with a number of Republican governors and veep potentials, ABC's Arlette Saenz notes. Romney will appear with Governors Chris Christie and Bob McDonnell and potentially others at the event in Basalt, Colo. NOTED: A number of potential running mates, including New Jersey Gov. Chris Christie, South Carolina Gov. Nikki Haley, Louisiana Gov. Bobby Jindal, Virginia Gov. Bob McDonnell, and New Mexico Gov. Susana Martinez head to Aspen today for the Republican Governors Association quarterly meeting and a few will participate at a conversation at the Aspen Institute.

OBAMA GETS A SUMMER BUMP: New polls from Quinnipiac/New York Times/CBS News give President Obama the lead over Romney in Pennsylvania (53 percent to 42 percent), Florida (51 percent to 45 percent), and Ohio (50 percent to 44 percent). The New York Times' Jeff Zeleny and Dalia Sussman write: "While independent voters break strongly for Mr. Obama in Pennsylvania, a state that Mr. Romney has been trying to make more competitive, they are closely split in Florida and Ohio. Of the coalition that Mr. Obama built to win the White House, independent voters remain a hurdle, with a little more than half in Florida and Ohio saying they disapprove of his job performance." http://nyti.ms/OCzJ7c

Conservative Republican Ted Cruz, who scored an upset - but rock-solid - victory over Lt. Gov. David Dewhurst in yesterday's Texas U.S. Senate runoff is being hailed today as the second coming of the current Florida senator and vice presidential short-lister.

"Just like the upstart Rubio, who started with long odds but defeated long time incumbent Florida Governor Charlie Christ in the 2010 GOP Primary with major support from the Tea Party, Cruz did exactly the same thing in Texas," the Christian Broadcasting Network's David Brody wrote in an analysis of last night's results. http://bit.ly/PokGJf

By Election Day, Cruz, a former Texas solicitor general, had already overtaken Dewhurst in recent polls. Cruz had the backing of Tea Party stalwarts like Sarah Palin and Sen. Jim DeMint whereas Dewhurst won the support of establishment figures like Texas Gov. Rick Perry, the erstwhile presidential hopeful.

As ABC's Elizabeth Hartfield points out, Cruz was also getting outspent. According to the Center for Responsive Politics, Dewhurst poured $11 million of his own personal fortune into his campaign, spending a total of $19 million, compared to the $7 million Cruz's campaign spent. http://abcn.ws/NI5w6B

So, what does one Republican's victory over a fellow GOPer in the bright red state of Texas mean in the grand scheme of things?

As Brody noted: "Eventually the media and others will realize that the Tea Party is not only far from dead it's just warming up."

But regardless of who wins control of the Senate this November, we know that the upper body in Washington is going to be as polarized and uncompromising as ever, notes ABC News Political Director Amy Walter. Conservative Republicans like Cruz and Richard Murdouck in Indiana won because they insisted they wouldn't be part of a "go along, get along" culture.

Ultimately, it also means that even if Romney is elected President he can't expect to win votes on "team spirit" alone.

To put it another way, as one smart Republican strategist told the Note: "The fact the Tea Party can win is the 2010 story; whether they can govern and what the 'establishment' will do to retool is the question."

SARAH PALIN SEND 'CONGRATS'. ABC's Shushannah Walshe points us toward Sarah Palin's Facebook page, which includes this note: "Congratulations to Ted Cruz! This is a victory both for Ted and for the grassroots Tea Party movement. This primary race has always been about the kind of leadership we need in D.C. Our goal is not just about changing the majority in the Senate. It is about the kind of leadership we want. ABC's RICK KLEIN: Has a race ever had such wild shifts in momentum without the dynamics really changing at all? Now it's President Obama's turn on the upswing, coming off of a rough foreign trip for Mitt Romney and three battleground state polls that show Obama topping 50 percent. But lest you think anything is really different, the messaging is back to expected form. A new Obama ad accuses Romney policies of exploding the deficit; a new Romney ad blasts Obama over closed GM dealerships. So yes, those ads with the candidates looking to camera to lay out their visions won't be all we're seeing for the next three months.

-The campaign also released this new web video hammering Obama over unemployment. "President Obama proudly proclaimed that his economic plan had 'worked.' Mitt Romney spent his life in the private sector and understands how to use government to create a business friendly environment. Rob Portman, who is often a surrogate campaigner in Ohio for Republican presidential candidate Mitt Romney. The Mansfield News Journal has run a series of stories and editorials expressing local worries that the air mission of the 179th Airlift Wing of the Ohio Air National Guard will end if proposed Pentagon budget cuts close it down. The local paper quotes Vice Commander Col. ABC's Devin Dwyer reports: President Obama has presided over three consecutive years of historically high federal budget deficits and the addition of more than $5 trillion to the national debt. Yet, in a new television ad for his re-election campaign, Obama casts himself as the only candidate for president with a plan to narrow the budget gap, while suggesting GOP rival Mitt Romney would make deficits worse. ? A PARTING GAFFE? ROMNEY PRAISED ISRAELI HEALTH SYSTEM. The Boston Globe's Matt Viser writes: "'We have to find ways, not just to provide health care to more people, but to find ways to finally manage our health care costs,' Romney said during the fund-raiser at the King David Hotel in Jerusalem. Romney's praise for Israel's health care system was greeted with some surprise. Under the law, small-group and individual-plan insurance companies that annually spend less than 80 percent of premium dollars on medical care owe their customers a rebate. USPS TO DEFAULT ON TREASURY PAYMENT. ABC's Sunlen Miller reports: Here's a totally unsubstantiated rumor: Senate Majority Leader Harry Reid, D-Nev., said that he's heard that Romney did not pay any taxes for 10 years. ? In an interview with the Huffington Post , Reid said that a month ago someone who invested with Bain Capital, called his office to say that Romney, "didn't pay any taxes for 10 years." ?
